These Terms of Service ("Terms") govern your access to and use of longevityquantified.com (the "Site") and the Puck hardware, companion app, and related services (together, the "Service"), all operated by Longevity Quantified, Inc. ("Longevity Quantified," "we," "us," or "our"). By accessing the Site or using the Service, you agree to be bound by these Terms. If you don’t agree, please don’t use the Site or the Service.
We may update these Terms from time to time to reflect changes to our products, services, or legal requirements. If we make material changes, we’ll update the date at the top of this page. Your continued use of the Site or Service after an update means you accept the revised Terms.
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to purchase the Puck or create an account. You’re responsible for the accuracy of the information you provide us and for keeping your account credentials confidential. You’re responsible for all activity that happens under your account.
The Puck is sold as a one-time purchase; access to the Essential, Performance, and Precision membership tiers is provided through optional monthly subscriptions that you can cancel anytime. We try to describe our products and pricing accurately, but we don’t guarantee that product descriptions, pricing, or availability on the Site are always error-free, complete, or current, and we may correct errors, change prices, or limit quantities at any time.
If you subscribe to a paid membership tier, you authorize us to charge your chosen payment method on a recurring basis until you cancel. You can cancel a subscription at any time; cancellation takes effect at the end of the current billing period.
You agree not to:
The Site, the Puck’s hardware and firmware, the companion app, and all related content, trademarks, and logos are owned by Longevity Quantified or our licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Site and Service for your personal, non-commercial use. Nothing in these Terms transfers any ownership rights to you.
The Puck and its companion app provide muscle-activity data intended to help you understand your training and movement; they are not medical devices and are not intended to diagnose, treat, cure, or prevent any disease or condition. Consult a qualified professional before making health or training decisions based on data from the Service.
The Site and Service are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
To the fullest extent permitted by law, Longevity Quantified will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising out of or related to your use of the Site or Service. Our total liability for any claim arising out of these Terms or the Service is limited to the amount you paid us in the twelve months before the claim arose.
You agree to indemnify and hold Longevity Quantified harmless from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your use of the Site or Service or your violation of these Terms.
We may suspend or terminate your access to the Site or Service at any time, with or without notice, if we believe you’ve violated these Terms. You may stop using the Site or Service, or cancel a subscription, at any time. Provisions of these Terms that by their nature should survive termination (including Intellectual Property, Disclaimers, Limitation of Liability, and Governing Law) will survive.
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved in the state or federal courts located in Delaware, and you consent to their jurisdiction.
If you have questions about these Terms, please get in touch and we’ll respond as soon as we can.
